Terms of Service

These terms are the agreement between you and Sudokoi ("we", "us", "our") covering your use of the Sudokoi iOS app. By installing or using the app you accept these terms.

1. The app

Sudokoi is a sudoku game for iPhone and iPad. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, for your own non-commercial use, subject to the Apple App Store Terms of Service and these terms.

You agree not to (a) modify, reverse-engineer, or attempt to extract the source code of the app, (b) redistribute or resell the app, (c) use the app in a way that violates applicable law, or (d) interfere with our servers, including by making excessive automated requests.

2. User content

Sudokoi does not accept user-generated content posted to a shared space. If you email us feedback or bug reports, you grant us a perpetual, royalty-free license to use the content of those messages to improve the app, while still respecting the Privacy Policy.

3. Intellectual property

The app's code, artwork, sound, and the Sudokoi name and logo are owned by us. Sudoku as a game format is in the public domain; specific puzzles included with the app or served via the daily endpoint are intended for your personal play under section 1.

4. Disclaimers

The app is provided "as is" and "as available." We do not warrant that the app will be uninterrupted, error-free, or that puzzles served by the daily endpoint will always be available. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

5. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising out of your use of the app. Our total aggregate liability for any claim related to the app or these terms will not exceed $50 USD.

6. Changes

We may revise these terms over time. Material changes will be flagged in the app's release notes. The effective date at the top of this page reflects the most recent revision. Continued use of the app after a change constitutes acceptance.

7. Termination

You can stop using the app at any time by deleting it. We may suspend or end access to our services for a particular client if our services are being abused.

8. Apple-specific terms

These terms are between you and us, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation for the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility, not Apple's.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you upon your acceptance of these terms.

9. Governing law

These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in North Carolina, except where Apple's App Store Terms of Service require otherwise.
